Dear User:
Before you become a registered HiredChina user and use the services provided by HiredChina, please carefully read the HiredChina "User Agreement" (hereinafter referred to as the "Agreement") to better understand the services we provide and your rights and obligations. Once you start using HiredChina services, it means you have confirmed and accepted all the terms in this Agreement.
This Agreement sets out the relevant rights and obligations between you (hereinafter referred to as "User" or "You") and Tianxia Yingcai (Shenzhen) Technology Co., Ltd. (hereinafter referred to as "HiredChina Company" or "We") (Company address: 10C2-3A, 10th Floor, Tianxiang Building, Tianshuma City, Tairan 5th Road, Tianan Community, Shatou Street, Futian District, Shenzhen) regarding the HiredChina software (hereinafter referred to as "this Platform" or "HiredChina"). HiredChina software is a serious and pure recruitment service software. Please read the following terms carefully before registering and using HiredChina.
1. Acceptance of Registration Terms
In accordance with the requirements of laws and regulations such as the "Cybersecurity Law" and "Regulations on the Administration of Internet User Account Information", by completing mobile SMS verification on the HiredChina registration page and checking to agree to the HiredChina "User Agreement" and other relevant agreements, you indicate that you have read and agreed to enter into this Agreement with HiredChina Company, become a HiredChina user, and accept to be bound by all registration terms in this Agreement, as well as all terms of the HiredChina 'Online Privacy Policy' (collectively referred to as "Platform Agreement" or "Platform Rules"), including dispute resolution clauses (see Article 15 of this Agreement).
2. User Registration and Certification
- Users applying for a HiredChina account must meet all of the following conditions simultaneously: the purpose must be for recruitment and/or job seeking at the time of registration and during the subsequent use of HiredChina services; must be 16 years of age or older at the time of registration.
- To better enjoy HiredChina platform services, users should comply with HiredChina's registration mechanism requirements, providing true, accurate, latest, and complete personal information to HiredChina. Users who register and are certified as recruiters (including users from employers and human resource service agencies) should ensure timely updates of their provided company name, "Human Resources Service License" and/or "Labor Dispatch License", job title or position information, corporate email, recruitment authorization letter, letter of commitment, and other relevant information and supporting documents, ensuring the authenticity of the aforementioned information and documents. Users shall ensure that their official actions, including but not limited to publishing recruitment information, communicating with job seekers, obtaining, using, and forwarding job seeker resumes, remain continuously valid during the use of this Platform. Certified users shall maintain the uniqueness of their recruitment account and the corresponding authorized entity.
- Users should use their real identity information for certification. HiredChina has the right to review and verify information provided by users in accordance with laws, regulations, and relevant service procedures. If a user provides false identity information, company information, or recruitment information, HiredChina has the right to refuse to provide services or suspend or terminate services to that user at any time.
3. User Accounts and Security
- Users shall be solely responsible for all activities conducted using their accounts, including any information, data, text, software, music, audio, photos, graphics, video, messages, or other materials uploaded, posted, emailed, or otherwise transmitted via HiredChina.
- In the event that a user's account is used without authorization, or any other security issue occurs, the user shall immediately notify HiredChina. If the user's data or information is leaked due to improper use or other reasons not attributable to HiredChina, the user shall bear the adverse consequences.
- The ownership of HiredChina accounts belongs to HiredChina Company. After completing the account registration process, users obtain the right to use their HiredChina account, and this right of use belongs only to the initial registrant of the account. Users may not give, lend, rent, transfer, or sell HiredChina accounts.
- Users shall not actively disclose their account to a third party or provide it to a third party for use, such as providing it to a third party to purchase HiredChina services on their behalf.
- If you plan to deactivate, abandon, or cancel the mobile number currently bound to your account, please contact customer service in advance to unbind the account.
4. Service Description
- HiredChina provides network services to users through the internet, including online and offline related businesses. To use network services, users should equip themselves with the necessary equipment to access the internet.
- When providing network services, HiredChina may charge certain fees for some network services. If a user refuses to pay such fees, they will not be able to use the relevant network services.
- Due to the special nature of digital goods, paid services do not support seven-day unconditional returns once purchased.
- HiredChina may irregularly conduct authenticity reviews and updated verifications of some users' company addresses, recruitment authorizations, and other relevant information. If a user refuses, HiredChina has the right to suspend or terminate services.
- HiredChina has the right to inform users of service-related advertising information, promotional offers, and other marketing information by means of phone calls, text messages, or emails.
- To improve efficiency, HiredChina may share job information posted by HiredChina users with our affiliated platforms and third-party partner platforms that we operate.
5. Limitation of Liability
- HiredChina will strive to provide users with safe, timely, accurate, and high-quality services, but cannot promise the effectiveness of users' use of the platform services, nor does it guarantee that the services will not be interrupted.
- In no event shall HiredChina be liable for any content transmitted by users via software/website services by posting, emailing, or otherwise. However, HiredChina has the right to legally stop the transmission of any such content.
- HiredChina does not guarantee the accuracy, legality, or reliability of third-party advertisement information, and the relevant responsibility shall be borne by the advertiser.
- Users shall independently judge the content posted by other users on HiredChina and bear all risks arising from the use of such content.
6. User Personal Information Rights
HiredChina protects users' personal information and privacy in accordance with the law.
Users have the following rights regarding their personal information:
- To inquire and request access at any time;
- To request supplementation or correction at any time.
For specific details regarding the privacy policy, please refer to the HiredChina 'Online Privacy Policy'.
7. User Platform Usage Obligations
When using HiredChina services, users shall comply with prevailing Chinese laws and regulations and applicable industry-specific laws and regulations. You are prohibited from:
- Opposing the fundamental principles established by the Constitution;
- Endangering national security;
- Damaging national honor and interests;
- Inciting ethnic hatred or discrimination;
- Undermining national religious policies;
- Spreading rumors or disturbing social order;
- Disseminating obscene, pornographic, or violent content;
- Insulting or defaming others;
- Publishing false information or recruitment of minors;
- Impersonating any person or organization;
- Using plugins, external tools, or crawlers ("spider" programs) to illegally obtain data without HiredChina's permission;
- Interfering with, disrupting, or bypassing any security features of the software.
8. Liability for Breach
If HiredChina verifies or has reasonable grounds to believe that a user has violated the agreement, HiredChina has the right to take punitive measures, such as deleting information or restricting functions. Any related fees paid shall not be refunded. Users shall compensate HiredChina or other partners for any losses arising from such breach.
9. Content Uploaded or Posted by Users on HiredChina
Content uploaded or posted by users (photos, text, reviews, etc.) shall be deemed as the user granting HiredChina Company a free, non-exclusive right to use for display and promotion purposes. Users bear full responsibility if uploaded content infringes upon the rights of others.
10. Instant Messaging Services like Interview Chat
HiredChina will temporarily store communication information in business scenarios for 30 days for purposes such as history inquiry, report handling, and security risk control. You shall not download or publicly publish other users' chat records. Any such infringement will lead to liability for breach.
11. Account Cancellation Service
Users have the right to request the cancellation of their HiredChina account. After successful cancellation, HiredChina will promptly delete your personal information or anonymize it in accordance with legal requirements.
12. Changes and Modifications to the Terms of this Agreement
HiredChina has the right to change and modify terms. If a user does not agree to the modified terms, they should actively stop using HiredChina. Continuing to use the account will be deemed as acceptance of all modifications.
13. Force Majeure
HiredChina shall not be liable for breach of contract due to force majeure events (government actions, natural disasters, hacker attacks, etc.), but shall make best efforts to mitigate negative impacts.
14. Notices
Notices will be in the form of system messages, pop-ups, emails, or page announcements.
15. Application of Law and Jurisdiction
The effectiveness, performance, interpretation, and resolution of disputes of this Agreement shall all be governed by the current laws of the People's Republic of China, and the place of signing of this Agreement is Shenzhen, Guangdong Province, People's Republic of China. If any dispute arises between you and HiredChina, both parties shall try to resolve it through friendly negotiation; if negotiation fails, you agree that the dispute shall be submitted to the people's court with jurisdiction at the place of signing of this Agreement for litigation resolution. If any term of this Agreement becomes invalid due to conflict with current laws of the People's Republic of China, it shall not affect the validity of other terms.
